Wojska Polskiego 31 89-632 Brusy Poland Number: +48 509 441 982 Email: [email protected] • TYTAX training machines and additional equipment for these machines are subject to warranty protection: • TYTAX machine body: 5 years, • All other components from which TYTAX machines and additional equipment for TYTAX machines are constructed: 2 years, The warranty does not cover: • Wear and tear of TYTAX machine components, during normal operation. For example, natural wear and tear of the paint finish, due to components rubbing against each other during exercise. Whether due to natural wear and tear of upholstery components during exercise. • Damage resulting from improper use of TYTAX products. For example, damage to the paint finish due to impact with other elements or mechanical damage to the upholstery, due to dropping a sharp object on the upholstery, or rubbing the upholstery with shoes.
If an item purchased from TYTAX INTERNATIONAL LLC or TYTAX FACTORY does not conform to what appears on the sales document, the filing of a claim should include: • description of the need for conformity of the goods with the sales document. • consumer demand, • proof of purchase: e.g. receipt, payment card printout, e-mail with purchase confirmation, witnesses. Note: The seller cannot condition the acceptance of a claim on the provision of a receipt. Goods are considered to be inconsistent with the sales document when: • does not correspond to the description given by the seller • does not match the sample or does not conform to the design presented to the consumer • is not suitable for the purposes specified by the consumer, which he informed the seller before concluding the contract • does not correspond to the characteristics that are attributed to goods of the same type • does not have the characteristics that a consumer can reasonably expect • does not correspond to the expectations for goods of this type, based on public statements made by the seller, manufacturer, or their representatives For evidentiary reasons, the complaint should be filed, immediately after noticing the non-conformity of the goods with the contract. This should not exceed 14 days. TYTAX INTERNATIONAL LLC or TYTAX FACTORY should consider the consumer's complaint, whether for damage or non-conformity of the goods with the sales document, within 14 (calendar) days of its submission. Exceeding this deadline means that the complaint is considered legitimate. In the event of a complaint, TYTAX INTERNATIONAL LLC or TYTAX FACTORY will make arrangements with the customer for the replacement or repair of parts and their delivery to the customer. And will agree to the return of the goods by the customer and the cost of purchase, in case of non-conformity of the goods with the sales document.
The extension of the warranty term is made when: • If, as a result of a warranty claim, the guarantor returned the item free of defects or made significant repairs to the advertised item, the warranty period is counted anew from the time of delivery of the item to the buyer. • If, as a result of a complaint, the guarantor has replaced parts in the advertised item, then the warranty period runs anew for the replaced parts. • In other cases, the warranty period is extended by the time during which the authorized person could not use the item due to its defect.
When exercising warranty rights for a product defect, the time limit for exercising rights for non-conformity with the contract is suspended - from the date of notification of the defect to the seller. The period continues to run from the date of performance of obligations under this warranty by the guarantor. Note: The rights granted under the warranty are independent of the rights, related to the non-conformity of the goods with the contract. If the consumer's demands are rejected, e.g. under the warranty, he has the right to claim based on non-conformity of the goods with the contract, and vice versa. A claim can be made in any form. It is best to do so in writing for evidentiary purposes. Any claim based on a malfunction or TYTAX equipment requires: machine model name, customer code number, date of installation, and any information confirming the existence of the alleged defect.
During the warranty period, TYTAX INTERNATIONAL LLC or TYTAX FACTORY shall bear the cost of repairing or replacing TYTAX parts that break. This depends on from whom the TYTAX training equipment was purchased. In addition to repair, replacement, price reduction, or cancellation of the contract as a result of a complaint, the consumer has the additional right to demand from the seller compensation for the damage he suffered due to the purchase of goods not in conformity with the contract. Such damage can be considered: • The cost of collecting the goods, returning the goods to the seller for claim purposes, transportation, and insurance (if shipped) • The cost of entering into a contract • Cost of storing goods Our standard warranty applies to the use of TYTAX equipment in training facilities where the equipment will be used by no more than 50 people per day. This warranty does not authorize any person to assume any obligations other than those expressly covered by this warranty. TYTAX INTERNATIONAL LLC or TYTAX FACTORY shall not be liable for economic loss; loss of profit or other damages that would result if, for the period of repair or replacement of a defective part during the warranty period, the TYTAX equipment may be out of service. This warranty is not assignable and applies only to the original purchaser/user to whom the product was delivered. TYTAX INTERNATIONAL LLC or TYTAX FACTORY will always strive to ensure that the customer never has to pursue a claim in court. If a dispute were to arise, TYTAX INTERNATIONAL LLC or TYTAX FACTORY will always strive to have the matter resolved out of court, in the case of complaint handling and claim investigation. TYTAX INTERNATIONAL LLC or TYTAX FACTORY guarantees that it remains available to the customer after the warranty period for performing any repairs or upgrades to equipment manufactured by TYTAX.
